Welcome to Menufy! These Terms of Service ("Terms") govern your use of our mobile application and website (menufy-iq.com) operated by Menufy ("we," "our," or "us").

By accessing or using Menufy, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our services.

By creating an account, accessing, or using Menufy, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

Menufy is a restaurant management system that allows users to:

• Browse restaurant menus and information.
• Place orders for food and beverages.
• View order history and track order status.
• Save favorite restaurants and dishes.
• Receive offers and promotions from restaurants.
• Access restaurant services through QR code scanning.

To use certain features of Menufy, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and update your account information to keep it accurate.
• Maintain the security of your account credentials.
• Accept responsibility for all activities under your account.
• Notify us immediately of any unauthorized use of your account.
• Be at least 13 years old to create an account.

When placing an order through Menufy:

• You agree to pay all charges associated with your order.
• Prices are set by restaurants and may change without notice.
• All sales are final unless otherwise stated by the restaurant.
• Restaurants reserve the right to refuse or cancel orders.
• Payment processing is handled by third-party payment processors.
• We are not responsible for payment processing errors or disputes.

You agree not to:

• Use Menufy for any illegal or unauthorized purpose.
• Violate any laws in your jurisdiction.
• Infringe on intellectual property rights.
• Transmit viruses, malware, or harmful code.
• Attempt to gain unauthorized access to our systems.
• Interfere with or disrupt the service.
• Harass, abuse, or harm other users or restaurant staff.
• Post false, misleading, or defamatory content.

All content on Menufy, including text, graphics, logos, images, and software, is the property of Menufy or its licensors and is protected by copyright and trademark laws. You may not:

• Reproduce, distribute, or create derivative works without permission.
• Use our trademarks or logos without written consent.
• Remove copyright or proprietary notices.

Restaurants are responsible for:

• The accuracy of menu items, prices, and descriptions.
• Food quality and safety standards.
• Order fulfillment and delivery times.
• Compliance with health and safety regulations.

Menufy is not responsible for restaurant content, food quality, or order fulfillment issues.

To the maximum extent permitted by law:

• Menufy is provided "as is" without warranties of any kind.
• We do not guarantee uninterrupted or error-free service.
• We are not liable for indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid for our services in the past 12 months.

You agree to indemnify and hold harmless Menufy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of Menufy.
• Your violation of these Terms.
• Your violation of any rights of another party.

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms.
• Fraudulent or illegal activity.
• Extended periods of inactivity.
• At our sole discretion for any reason.

You may terminate your account at any time by contacting us or using account deletion features in the app.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

• Posting updated Terms on our website.
• Sending notifications through the app.
• Updating the "Effective Date" at the top of these Terms.

Your continued use of Menufy after changes become effective constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of Iraq. Any disputes arising from these Terms or your use of Menufy shall be subject to the exclusive jurisdiction of the courts of Erbil, Iraq.
